The following data protection declaration applies to the use of our website and the email/fax correspondence with customers, potential customers and other interested parties.

2 Collection and storage of personal data as well as type and purpose of their use

With the exception of the technical data processing described below (2.2-2.6), the mere use of our website for information purposes is possible without processing personal data.

2.1 Use of our electronic contact options (email, fax)

If you contact us via email or fax, your personal data will be processed electronically for the purpose of responding to your request or carrying out your order. Data processing for the purpose of contacting us is carried out on the basis of your voluntary consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO, unless there is a further statutory authorisation.

By entering personal data by you or sending inquiries via an e-mail address containing personal data, you give your consent to data processing for the purpose described above. Your consent can be revoked in text form at any time, the legality of data processing until revocation remains unaffected.

The processed personal data collected for correspondence will be deleted after the complete processing of your request, provided that there is no further evidence justifying the processing (e.g. execution of the order, processing on the basis of Art. 6 para. 1 lit. b DSGVO, statutory storage obligations of a tax and profession-specific nature).

We would like to point out that data transmission over the Internet (e.g. communication by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible. Within the framework of the necessary electronic transmission, the data is processed by our email provider/telephone provider as order data processor, with whom appropriate contracts exist to comply with data protection regulations.

2.2 Invitations to events

If you have expressly consented, we will use your e-mail address to send you invitations to events 1-2 times a year. The revocation of the consent, even if it was already given before 25.05.2018, is possible at any time by deregistration by email to info@metralabs.com

2.3 When visiting the website

When you visit our website www.metralabs.de or www.metralabs.com, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

IP address of the requesting computer,
Date and time of access,
Name and URL of the retrieved file,
Website from which access is made (referrer URL),
the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
The mentioned data will be processed for the following purposes:

Ensuring a smooth connection of the website,
Ensure comfortable use of our website,
evaluation of system security and stability as well as
for other administrative purposes.
Protection against unauthorized access to our website
The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f DSGVO. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

If you contact us with questions of any kind using the contact form, please give us your voluntary consent for the purpose of contacting us. A valid e-mail address is required for this purpose. This is used to assign the request and then reply to it. The specification of further data is optional. The information you provide will be stored for the purpose of processing your inquiry and for possible follow-up questions. After your request has been processed, your personal data will be automatically deleted.

In addition, we use the Google Analytics/Cookies analysis service when you visit our website. For more information, see below.

2.4 Google Analytics, Google AdWords and Cookies

We may use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do no damage to your end device, do not contain viruses, Trojans or other malware.

Information is stored in the cookie that results in each case in connection with the specifically used terminal device. However, this does not mean that we immediately become aware of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These will be deleted automatically after leaving our site.

In addition, we also use temporary cookies that are stored on your end device for a specified period of time to optimize user-friendliness. For the purpose of demand-oriented design and continuous optimization of our pages, we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/en/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter „Google“). In this context, pseudonymized user profiles are created and, if necessary, cookies (see point 4) are used. The information generated by the cookie about your use of this website such as

Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymized so that an assignment is not possible (IP masking). You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website.

We may use Google Conversion Tracking to statistically record the use of our website and evaluate it for the purpose of optimising our website for you. Google Adwords sets a cookie (see paragraph 4) on your computer if you have accessed our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can recognize that the user has clicked on the ad and has been redirected to this page.

Each Adwords customer receives a different cookie. Cookies cannot therefore be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, you will not receive any information that personally identifies users.

If you do not wish to participate in the tracking process, you can also reject the setting of a cookie required for this – for example using a browser setting that generally deactivates the automatic setting of cookies. 2.5 YouTube

On some of our webpages, we embed YouTube videos. YouTube is an Internet video portal that allows video publishers to post video clips and other users to view, rate and comment on them free of charge. YouTube allows the publication of all types of videos, which is why complete film and television programmes, music videos, trailers or videos produced by users themselves can be called up via the Internet portal.

YouTube is operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Each time one of the individual pages of this website is accessed, which is operated by the data controller and on which a YouTube component (YouTube video) has been integrated, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube component from YouTube. More information about YouTube can be found at https://www.youtube.com/yt/about/de/. In the course of this technical procedure, YouTube and Google are informed which specific subpage of our website is visited by the person concerned.

If the person concerned is logged on to YouTube at the same time, YouTube recognizes which specific subpage of our website the person concerned visits by calling up a subpage that contains a YouTube video. This information is collected by YouTube and Google and assigned to the respective YouTube account of the person concerned.

YouTube and Google receive information via the YouTube component that the person concerned has visited our website whenever the person concerned is logged on to YouTube at the same time as accessing our website; this happens regardless of whether the person concerned clicks on a YouTube video or not. If such a transmission of this information to YouTube and Google is not desired by the person concerned, this can prevent the transmission by logging out of their YouTube account before calling up our website.

The data protection regulations published by YouTube, which can be accessed at https://www.google.de/intl/de/policies/privacy/, provide information about the collection, processing and use of personal data by YouTube and Google.

2.6 Use of Matomo

This website uses Matomo (formerly Piwik), an open source software for statistical analysis of visitor access. Matomo uses cookies, which are text files placed on your computer, to help the website analyze how users use the site.

The information generated by the cookie about your use of the website is stored on a server in the USA.

The IP address is made anonymous immediately after processing and before it is stored. You have the option of preventing the installation of cookies by changing the setting of your browser software. We would like to point out that with the appropriate settings not all functions of this website may be available anymore.

You can decide whether a unique web analysis cookie may be stored in your browser to enable the operator of the website to collect and analyze various statistical data.

3 Passing on of data

Your personal data will not be transmitted to third parties for purposes other than those listed below.

We will only pass on your personal data to third parties if:

you have given your express consent pursuant to Art. 6 para. 1 sentence 1 lit. a DSGVO,
the disclosure pursuant to Art. 6 para. 1 sentence 1 f DSGVO is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, and
this is legally permissible and is necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b DSGVO.

4 Your rights

You have the right:

to request information about your personal data processed by us in accordance with Art. 15 DSGVO. If we process personal data, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these were not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
to immediately request the correction of incorrect or complete personal data stored by us in accordance with Art. 16 DSGVO;
to request the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
pursuant to Art. 18 DSGVO, to restrict the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing pursuant to Art. 21 DSGVO;
pursuant to Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request the transmission to another person responsible, insofar as your data are processed automatically;
in accordance with Art. 7 para. 3 DSGVO, to revoke your consent to us at any time. As a consequence, we are no longer allowed to continue the data processing based on this consent for the future and, in accordance with Art. 77 DSGVO, to complain to a supervisory authority, for Thuringia the Thuringian State Representative for Data Protection and Freedom of Information, Postfach 900455, 99107 Erfurt, Häßlerstraße 8, 99096 Erfurt. You can also contact the supervisory authority of your usual place of residence or work.

5 Right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 letter f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that there are reasons for this which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which we will implement without specifying a particular situation.

6 Data security

We use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties.

7 Changes to our data protection regulations

We reserve the right to adapt this data protection declaration so that it always complies with current legal requirements or to implement changes to our services in the data protection declaration, e.g. when introducing new services. The new data protection declaration will then apply for your next visit.
